These Terms are a contract between you and CardFloor LLC ("CardFloor", "we", "us") covering every use of the CardFloor mobile app and the website at cardfloor.app, by any means, including automated means. By creating an account, using the app, or accessing any page of the website, you agree to them — whether or not you have an account. If you don't agree, don't use or access CardFloor.
Our Privacy Policy explains what we collect and is part of these Terms.
CardFloor is a record-keeping and reference tool for trading-card collectors and vendors. It helps you identify cards, estimate what they're worth, track inventory, and log the buying and selling you do at shows.
CardFloor is not a marketplace, broker, dealer, escrow, appraiser, authenticator, or grading service, and we are never a party to your transactions. When you buy, sell, or trade a card, that deal is between you and the other person. We don't take payment, hold funds, verify either side, or guarantee anything about the card or the counterparty. Any dispute is between the two of you.
This is the most important section in this document, so it is in plain language.
Every price CardFloor shows you — including the "CardFloor Price", market prices, graded ladders, sold comparables, and any offer percentage the app calculates — is an estimate. It is produced from third-party data and public sales listings that we do not control and cannot verify. It may be out of date, incomplete, mismatched to the wrong card or the wrong printing, or simply wrong.
CardFloor uses automated image recognition and text recognition to identify cards and to read information printed on graded slabs (such as a grading company, a grade, or a certification number).
Authenticity and grading are for the issuing grading company to determine. Verify certification numbers directly with that company before relying on them.
CardFloor is under active development. It will contain bugs. It may change, break, or become unavailable without notice, and features may be added or removed. Data you enter may be lost, corrupted, or reset. Keep your own records of anything you cannot afford to lose — CardFloor is not a system of record for your business, your taxes, or your accounting.
You keep ownership of everything you put into CardFloor — your inventory, your photos, your deals, your notes. You grant us a licence to host, process, back up and display that content strictly to operate the app for you.
Separately, CardFloor builds an anonymized market index from completed sales: the card, its condition and printing, the price, and the date. These records contain no identifier for you — no name, no account id, no show, no location — and cannot be traced back to you or your business. We use them to make market prices reflect what cards actually trade for at real shows, and you get the benefit of everyone else's contributions in return.
You can turn this off at any time in Settings → Privacy → Contribute to the market index. Turning it off stops future contributions. Records already contributed are anonymous and cannot be identified or withdrawn afterwards, because nothing links them to you.
CardFloor — the app, the website, and everything we produce or compile, including the CardFloor Price and every other price estimate, price history, graded prices, sales data as we collect and present it, confidence ratings, card and set catalogues, images we host, and the selection and arrangement of all of it — belongs to CardFloor LLC or our licensors and is protected by copyright, database, trade-secret, and other laws.
We give you a limited, personal, non-exclusive, non-transferable, revocable licence to use CardFloor through our official app and website for your own collecting, or for your own business's buying and selling. Nothing else is licensed to you. The licence never covers anything section 8 prohibits, and it ends automatically the moment you breach these Terms.
CardFloor is for people. You may access CardFloor only through our official apps, or a standard web browser operated by a person at a person's pace. Every form of automated access, data collection, or copying below is prohibited, whether done by you or by anyone or anything acting for you.
You may not, and may not help, instruct, or allow anyone else to:
Search engines. General-purpose public search engines may crawl the public pages of our website, in line with our robots.txt, solely to list them in search results. That permission does not extend to prices or other data for any other purpose — including datasets, archives, price comparison, or AI training — and we may withdraw it at any time.
Enforcement. We monitor for automated access. If we believe you have breached this section, we may, without notice: block your access; suspend or terminate any account; and serve limited, delayed, or altered data to traffic we believe is automated. Any breach of this section is a material breach of these Terms and access to our systems without authorization, and we may pursue every remedy available at law or in equity — including injunctive relief (you agree that a breach would cause us irreparable harm), damages, and recovery of our reasonable attorneys' fees and costs.
Don't: break the law; infringe anyone's rights; upload malware; probe, scan, or test the vulnerability of, or overload, our systems or our providers' systems; submit deliberately false sales in order to distort the market index; impersonate anyone; or use CardFloor to defraud another user.
CardFloor depends on outside services for card catalogues, images, prices and sales data. We are not affiliated with, endorsed by, or sponsored by any grading company, marketplace, publisher, or card manufacturer. Card names, set names, images and trademarks belong to their respective owners and appear here for identification only. Third-party services can change, restrict, or stop providing data at any time, which may degrade or remove features.
CardFloor does not currently charge for any feature. If we introduce paid subscriptions, we'll tell you before charging, and billing will be handled by the Apple App Store or Google Play under their terms — including their refund policies, which we do not control.
CARDFLOOR IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY PRICE, IDENTIFICATION, OR OTHER INFORMATION IT PROVIDES IS ACCURATE, COMPLETE, OR CURRENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, CARDFLOOR LLC AND ITS OWNERS AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST REVENUE, LOST BUSINESS, LOST DATA, OR TRADING OR PURCHASING LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF CARDFLOOR — INCLUDING ANY DECISION YOU MAKE TO BUY, SELL, TRADE, PRICE, OR DECLINE A CARD BASED ON INFORMATION IN THE APP — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO CARDFLOOR WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED US DOLLARS ($100).
Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.
You agree to indemnify and hold harmless CardFloor LLC from claims, damages, and reasonable legal costs arising out of your use of the app or website, your content, your transactions with other people, any automated access or data collection by you or on your behalf, or your breach of these Terms.
You may stop using CardFloor and request deletion of your account at any time (see the Privacy Policy). We may suspend or terminate an account that breaches these Terms or creates risk for other users or for us. Sections 2, 3, 6, 7, 8, 12, 13, 14 and 17 survive termination.
We may update these Terms. If the changes are material, we'll ask you to accept them in the app before you continue. The version and date at the top of this page always tell you which set is current.
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules, and the state and federal courts located in Massachusetts have exclusive jurisdiction.
